His daughter, Mrs. WANDA Cy, ,,,. said, "e don't want him (McINTOSH) using our family name for whatever reason he might be using it." The June 18, 1965, issue of the "Dayton Joinal ' .. Herald" carried an article reporting the awarding of ,amages . of $5,000.00 to a Middletown policeman who had been libeled by the "New Ohio. Eagle, '-anewspaper which was organized in July, 1964, for circulation primarily among Negroes. It was edited by McINTOSH. In one of -the very first issues of the newspaper it carried a story which said a Miiddletown, Ohio, -, -1 - woman had been beaten by policemen who arrested her without cause. The story also said the woman had filed a suit against the officers. Court records showed no such suit was ever filed - by the woman. The Middletown Police Officers sued, The newspaper had to go into bankruptcy. In awarding the damages Judge CECIL EDWARDS, Montgomery County Common Pleas Judge, said "This type of publicity makes the business of enforcing the law more difficult. The fact that the testimony was unrefuted indicates that none of the statements made by the paper were true."
